1. Introduction

Welcome to PrimeVoIP! These Terms of Service (“Terms”) govern your use of the VoIP (Voice over Internet Protocol) services (“Services”) provided by PrimeVoIP (“we”, “our”, “us”). By accessing or using our Services, you (“Customer”, “you”) agree to comply with and be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, you must not use our Services.

2. Acceptance of Terms

By opening an account with PrimeVoIP and using our Services, you affirmatively acknowledge that you have read, understood, and agreed to these Terms. If you do not accept these Terms, you must immediately discontinue use of the Services. You agree that by registering for and using our Services, you enter into a binding agreement with PrimeVoIP.

3. Client Responsibility

As a client, you are solely responsible for your use of our Services. You agree that:

  • You will comply with all local, national, and international laws, regulations, and ordinances related to the use of VoIP services in your jurisdiction.
  • You will not use PrimeVoIP Services for any illegal, fraudulent, abusive, or harmful activities, including but not limited to telemarketing, spam, harassment, fraud, or violations of intellectual property rights.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.
  • PrimeVoIP reserves the right to suspend or terminate your account if we believe that you have violated these Terms or engaged in any illegal activity.

4. Legal Compliance and Local Laws

It is your responsibility to ensure that your use of our Services complies with the laws of the country in which you reside and operate. By using PrimeVoIP’s Services, you acknowledge and agree to adhere to the following:

  • You are responsible for complying with any laws that may regulate or restrict the use of VoIP services in your country, region, or jurisdiction.
  • PrimeVoIP does not assume any responsibility for violations of any local or international laws resulting from your use of our services.
  • If you reside in or operate from a country where VoIP services are restricted or prohibited by law, you may not use PrimeVoIP services, and PrimeVoIP will not be held responsible for any consequences arising from such use.

5. Service Use and Restrictions

PrimeVoIP provides VoIP services to facilitate voice communication over the internet. You agree to use our services solely for lawful purposes and in accordance with these Terms. The following are prohibited uses of our Services:

  • Using the Services for fraudulent activities, including identity theft, credit card fraud, or any other form of deception.
  • Making calls to emergency services (e.g., 911 or equivalent) unless explicitly permitted by applicable laws or regulations.
  • Using the Services to distribute, send, or promote unsolicited communications such as spam, phishing attempts, or any form of advertising without consent.
  • Engaging in any activity that could impair, disrupt, or interfere with the operation of our Services, including but not limited to denial-of-service attacks, hacking, or the distribution of malware.

6. No Responsibility for Misuse

PrimeVoIP does not assume responsibility for any misuse of the Services. You acknowledge and agree that:

  • You are responsible for ensuring that you and any users authorized by you to access your account comply with these Terms.
  • PrimeVoIP will not be liable for any damages or losses resulting from the misuse of the Services by you or any third party accessing your account.
  • In the event of misuse, including illegal activities or activities violating these Terms, PrimeVoIP reserves the right to suspend or terminate your account without refund.

7. Payment, Balances, and Charges

PrimeVoIP offers its Services on a prepaid basis. All payments for the Services are due in advance, and you agree to pay all applicable fees as determined by PrimeVoIP. PrimeVoIP reserves the right to change pricing at any time, at our sole discretion, and will provide reasonable notice of such changes via our website or email.

By using the Services, you agree that:

  • Your account balance is non-refundable and cannot be exchanged for cash or credit except in accordance with PrimeVoIP’s specific policies.
  • PrimeVoIP may adjust the balance of your account at any time and for any reason, including but not limited to errors in billing or changes in the pricing structure.
  • PrimeVoIP reserves the right to suspend or terminate your account if your payment is not received or if your account balance is insufficient to cover outstanding charges.
  • PrimeVoIP is under no obligation to refund or reimburse clients for any unused balances in the event of account termination, cancellation, or suspension.

8. Termination of Account

PrimeVoIP reserves the right to suspend or terminate your account if we determine that you have violated these Terms or engaged in illegal activity. In such cases:

  • Your account will be suspended, and you will lose access to the Services.
  • No refunds or reimbursements will be provided for any unused balance or service fees.
  • We may provide notice of termination unless such notice is prohibited by law.

9. Limitation of Liability

To the fullest extent permitted by applicable law, PrimeVoIP will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or in connection with your use or inability to use our Services, including but not limited to loss of profits, loss of data, or service interruptions.

PrimeVoIP makes no warranties regarding the accuracy, reliability, or availability of our Services and disclaims any liability for any service disruptions, outages, or technical issues that may affect your access to the Services.

10. Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which PrimeVoIP is incorporated. You agree to submit to the exclusive jurisdiction of the courts located in the jurisdiction of PrimeVoIP's incorporation for any disputes arising out of these Terms.

Any disputes that cannot be resolved amicably between you and PrimeVoIP will be resolved through binding arbitration in accordance with the rules of the jurisdiction governing these Terms.

11. Changes to Terms

PrimeVoIP reserves the right to modify, amend, or update these Terms at any time, at our sole discretion. Any changes will be posted on our website, and the updated version will be effective immediately upon posting. You are responsible for reviewing these Terms periodically to stay informed of any changes.
